In offering to the public a second edition of The Law of Civilization and Decay I take the opportunity to say emphatically that such value as the essay may have lies in its freedom from any preconceived bias. All theories contained in the book, whether religious or economic, are the effect, and not the cause, of the way in which the facts unfolded themselves. I have been passive. The value of history lies not in the multitude of facts collected, but in their relation to each other, and in this respect an author can have no larger responsibility than any other scientific observer. If the sequence of events seems to indicate the existence of a law governing social development, such a law may be suggested, but to approve or disapprove of it would be as futile as to discuss the moral bearings of gravitation. Some years ago, when writing a sketch of the history of the colony of Massachusetts Bay, I became deeply interested in certain religious aspects of the Reformation, which seemed hardly reconcilable with the theories usually advanced to explain them. After the book had been published, I continued reading theology, and, step by step, was led back, through the schoolmen and the crusades, to the revival of the pilgrimage to Palestine, which followed upon the conversion of the Huns. As ferocious pagans, the Huns had long closed the road to Constantinople; but the change which swept over Europe after the year 1000, when Saint Stephen was crowned, was unmistakable; the West received an impulsion from the East. I thus became convinced that religious enthusiasm, which, by stimulating the pilgrimage, restored communication between the Bosphorus and the Rhine, was the power which produced the accelerated movement culminating in modern centralization.

I assume it to be generally admitted, that possibly man's first and probably his greatest advance toward order-and, therefore, toward civilization-was the creation of the family as the social nucleus. As Napoleon said, when the lawyers were drafting his Civil Code, "Make the family responsible to its head, and the head to me, and I will keep order in France." And yet although our dependence on the family system has been recognized in every age and in every land, there has been no restraint on personal liberty which has been more resented, by both men and women alike, than has been this bond which, when perfect, constrains one man and one woman to live a joint life until death shall them part, for the propagation, care, and defence of their children.

And so it was with the Puritans, who were themselves the children of the revolt against social corruption. They fondly believed that a new era was to be ushered in by the rule of the Cromwellian saints. What the Cromwellian saints did in truth usher in, was the carnival of debauchery of Charles II, in its turn to be succeeded by the capitalistic competitive age which we have known, and which has abutted in the recent war.

Municipal law, to be satisfactory, should be a body of abstract principles capable of being applied impartially to all relevant facts, just as Marshall and Jay held it to be. Where exceptions begin, equality before the law ends, as I have tried to show by the story of King David and Uriah, and therefore the great effort of civilization has been to remove judges from the possibility of being subjected to a temptation, or to a pressure, which may deflect them from impartiality as between suitors.
